District Court Vacates Third-Country Transit Ban, Effective Immediately

The judge stated that the government did not comply with the APA’s notice-and-comment requirements because neither the “good cause” nor the “foreign affairs function” exceptions are satisfied, thus granting the advocates’ motions for summary judgment and vacating the rule.
